Nachrichtenagentur AFP mahnt weiterhin Betreiber von Websites ab

Bereits vor einigen Wochen ging die Meldung durch die Presse und die Blogs, dass die französische Nachrichtenagentur AFP in großem Stil Betreiber von Websites und Blogs abmahnt, wegen angeblicher Übernahme von Pressemeldungen.

Diese Abmahnwelle geht aktuell offenbar weiter. Mir liegt eine aktuelle Abmahnung vor, die gleich aus mehreren Gründen problematisch ist. Die Presseagentur AFP mahnt nämlich keineswegs (nur) identische Übernahmen von Meldungen ab, sondern auch ähnliche Meldungen zum selben Thema, die sich aber merklich von der AFP-Version unterscheiden. In einem Fall ist sogar so, dass AFP selbst nur die Pressemittelung eines Unternehmens abgeschrieben und dauraus eine eigene Meldung gemacht hat. Gleichwohl glaubt man, dies abmahnen zu können.

Rechtlich begibt sich AFP damit insgesamt auf sehr dünnes Eis.

Ob Agenturmeldungen als Sprachwerke überhaupt dem Schutz des Urheberrechts unterliegen, ist zweifelhaft. In der Kommentarliteratur zum UrhG (z.B. Schricker, § 2, Rn. 116) wird die Auffassung vertreten, dass kurze Meldungen und Nachrichten kein Werk darstellen, wenn sie sich im Bereich des Routinemäßigen bewegen. Das würde bedeuten, dass zumindest der überwiegende Teil der Agenturmeldungen nicht urheberrechtlich geschützt ist, sondern einm Schutz allenfalls dann in Betracht kommt, wenn sich die Meldung im Einzelfall in außergewöhnlicher Weise von vergleichbaren Nachrichten abhebt.

Was keinesfalls geschützt ist, ist die enthaltenen Information als solche. Nachdem die sprachlichen Möglichkeiten gerade bei kurzen Meldungen begrenzt sind, dürfte eine Urheberrechtsverletzung jedenfalls dann ausscheiden, wenn die Nachricht mit eigenen Worten umformuliert worden ist.

Im Einzelfall können zudem die Privilegierungen der §§ 49, 50 UrhG greifen.

Die Abmahnwelle, die AFP gestartet hat, ist daher in hohem Maße fragwürdig.
